Mark Cuban sues YouTube

Mark Cuban the tech billionaire has filed a lawsuit against YouTube asking it to report users who upload videos which one of his investments own the copyrights to.
Last year, when YouTube was purchase by Google, Cuban infamously called the move "moronic." He claimed that the video sharing site was based completely on the illegal distribution of copyrighted material and therefore should not be in existence.

Magnolia Pictures, the film distributor which is partially owned by Cuban is demanding that Google and YouTube report critical details of users who have uploaded clips of its movies, which most famously include the documentaries "Enron: The Smartest Guys in the Room" and "Capturing the Friedmans".

The subpoena expects Google to fork over the user details before March 20th.

Cuban has made it clear however, that the filing is more about making a point to Google and YouTube then to get individual users in trouble. He explained to Reuters this morning that "We don't expect to get valid user information. If we do, we will contact them and ask them what induced them to upload content they don't own."



Fox issued a very similar subpoena in January, except their lawsuit identified one uploader in particular, a man who had uploaded many Simpsons and 24 episodes.

I mean All in All Cuban is Right...
a lot of stuff on youtube is copyright infringement..
But who Really Cares these days, it wont stop anyways....

There is a LOT of copyright infringement EVERYWHERE,but that does NOT make Cuban RIGHT!

mr. cuban, you are correct, youtube is 99% copywrited material and wouldnt be a fraction of itself if it was totaly devoid of copywrited work. wed have clips of bbc shows and clips of nba games, and clips of gay soccar games and millions of redneck home videos...

but guess what mr cuban (and any other pissed off copywrite holders) the time of being able to record something once and live off it for the rest of your life is over. the people have voted with their use of youtube and p2p networks, your kind isnt welcome anymore, and your old monopolistic buisness model is no longer welcome ether. from now on make shit free or we will make it free for you.

3 years ago I'd fully agree with what you said... but as a struggling digital download music store, I'm going to have to disagree. Cuban (or whoever for that matter) MADE those programs etc etc. They own the rights to them, not you, not I, and of course, not youtube. They can have all there shows banned from youtube and you won't see anything from a particular artist or media group.

Yes, P2P has paved the way for digital distribution for files. Not just mp3s or movies, but all kinds of files.

Yes, the MPAA and the RIAA take things a bit far, but when it comes down to it, YOU DON'T OWN THEIR STUFF, they do.

So share in the personal time or whatever, but remember, if no one buys stuff, then how will GOOD artists actually make it?

djgizmo I am not sure I fully understand the point of your post. I agree they (mafiaa) have taken it too far BUT guess what it was my money that kept their business in existence, when i used to spend it on their overpriced DRM laden products. SO with that being said I will keep my money and they and you can go out of business.

OR they can figure out a new business model.
One that does not trample on my fair use rights, invade my privacy, open up my valuable pc with rootkits, and just generally treat me as criminal when I HAVE LEGALLY purchased their product.

I have to agree with 'Blackjax'.

But I will take this further and state that when I myself have LEGALLY purchased any type of media... then I have some news for all those big companies and the 'mafia' dudes ... as far as I am concerned I DO OWN THE RIGHTS to the original media I purchased, and If I happen to own 4 cars, 2 boats and 10 multimedia systems in my home ... then I will make a copy for each of those systems.. and they kiss my ... if they think otherwise!

Also if they would ALL stop wasting millions (probably billions) of $$$$ on copy protection schemes, etc ... and use that money to REDUCE the retail prices to something fair & reasonable ... NOT THE RIP-OFF they are now.. then more people would be willing to purchase original copies.

Also in the news this week, the US media companies wanted Canada (RCMP) to help stop all the piracy here ( yep I'm from up here )... otherwise they would delay the releases of the newest media.

I say " GO RIGHT AHEAD BOYS " ... if lets say ... 50% of candians get illegal copies... that means 50% are STILL BUYING. If the media companies want to loose out on that 50% as well.. it's no money out of our pockets! I am very glad & PROUD of our RCMP responding back that " we have more important things to work on ".

'Blackjax' has another point thats 'dead on the mark' ...
TOO MANY companies nowadays base their business models on a 100% (or near that) sale without losses. That kind of archaic logic is no longer valid in todays 'totally interconnected' market & society.

I guess I will have 'opened up' a big can of worms here ...

You guys are missing the point here, Mark Cuban isnt someone that grew up with a spoon in his mouth like the MPAA and RIAA. Cuban made his money the hard way. Its not like Magnolia is making tons of money off of Enron and Friedmans. They need that money that they are loosing when something gets pirated.

Just because he owns a basketball team doesnt mean he makes a lot of money. His team is either right up against the cap or over the salary cap and basketball never sells out until the playoffs roll around.
I'm not saying that I'm some kind of saint that hasnt downloaded anything but whenever someone tries to protect their stuff you guys rip him a new one when you would be doing the exact same thing where you in their position.

perhaps its about time for the whole 'entertainment' industry to have a total re-think and overhaul, If i pay money for an album or dvd i wanna be able to do w/e the hell i want with it, afterall its mine mine mine! they need to change the way they earn their money, maybe a bit more equally distributed money somehow is the way to go, afterall certain actors and artists are paid an obscene amount of money, surely if something is watched a thousand times on you-tube its called free advertising???? c'mon ppl get with the times.. copyrite laws are a an outdated piece of legislation that should have stayed in the 20th century.... this is the 21st century guys

Cuban complains and yet there are so many people suffering today! (3rd world countries) All Am trying to say is that, if he's gonna loose some bucks because of this(considering he's a millionaire),then its like loosing some penny for him.

Now, here's what I wanna know from billionaire's and millionaire's. Instead of putting your effort into suing some companies because you lost some bucks, wouldn't it better if you just help the people who are dying? Its really ridiculous that a man can possess so much wealth that they couldn't do anything to change the world. The irony is that Mark Cuban made his money by streaming copyrighted material across the internet. He and his buddys wanted to listen to sports broadcasts from thier favorite college, but were too far away to pick up a signal.

Your wrong there. You paid for a copy of something they own and you can make a backup copy if you got bratty kids that destroy things or you can put it on your computer to transfer to your ipod, but you cant upload/make available something on the internet that isnt yours.
